Buyer/Seller Agreement for Live Birds & Hatching Eggs
PLEASE READ BEFORE YOU DECIDE YOU WANT EGGS/CHICKS
This agreement outlines the terms and conditions between the Buyer and the Seller, Williams & Whitman Homestead, regarding the purchase of live birds and/or hatching eggs. By placing a deposit, purchasing, or accepting birds or eggs from Williams & Whitman Homestead, the Buyer acknowledges that they have read, understood, and agreed to the following terms and conditions.

1. All Sales Are Final
* All sales are final. Please carefully consider your purchase before committing.* Deposits, holds, and placements on egg or chick waitlists are non-refundable and non-transferable.* Waitlists and reservations are fulfilled on a first come, first served basis.

2. Responsibility After Pickup
* Once birds or hatching eggs leave our care, the Buyer assumes full responsibility for their health, safety, care, fertility, hatch rate, behavior, injury, illness, or death.* Williams & Whitman Homestead is no longer responsible for birds or eggs after in-person pickup.

3. Pickup Policy
* We currently offer local pickup only and do not ship at this time.* We do not provide refunds or replacements for illness, injury, stress-related loss, or mortality occurring after pickup.* Guidance and care recommendations may be provided at our discretion to assist Buyers with acclimation and care.

4. Hatching Egg Disclaimer
* Hatching eggs are a naturally unpredictable product, and hatch results may vary due to circumstances beyond our control, including incubation methods, handling, temperature fluctuations, humidity, and transportation.* We do not guarantee hatch rates, fertility, gender, feather quality, or show quality.* We strive to provide healthy, quality eggs collected from carefully maintained breeding groups.

5. Project Color & Breeding Project Disclaimer
* Certain breeding projects, including but not limited to Mottled, Fun Pen, and other project pairings, may produce a wide variety of outcomes.* Possible outcomes may include: * Off-pattern or unexpected coloring * Leakage or imperfect markings * Satin or frizzled feathering * Toe or wing defects * Other cosmetic or breeding-related faults* By purchasing project birds or hatching eggs, the Buyer acknowledges and accepts the risks associated with experimental or project breeding programs.* No refunds or replacements will be offered for unexpected traits, colors, feather types, or faults.

6. Wait Times for Eggs & Chicks
* Availability and wait times may vary due to weather, seasonal laying cycles, fertility rates, flock health, hatch rates, and overall demand.* Estimated wait times are not guaranteed.* We appreciate your patience and will communicate updates as they become available.

7. Health & Care
* All birds are cared for to the best of our ability and leave our homestead appearing healthy and well-maintained.* Buyers are responsible for proper quarantine, housing, nutrition, predator protection, and ongoing care after pickup.* Because conditions outside our care cannot be controlled, we cannot guarantee future health or performance once birds leave our homestead.

8. Gender Policy
* All birds are sold as straight run unless otherwise stated in writing.* We do not guarantee gender of pullets or cockerels.* No refunds or exchanges will be provided for birds that mature into an undesired gender.

9. Agreement of Terms
By submitting payment for an invoice, deposit, waitlist placement, live birds, chicks, or hatching eggs from Williams & Whitman Homestead, the Buyer confirms that they have read, understood, and agreed to all terms outlined in this agreement.
